If you hold a working holiday visa (Subclass 417/462), a temporary graduate visa (Subclass 485) or a student visa (Subclass 500) for Australia read this article! There have been some major developments.

Prime Minister Scott Morrison has just announced that the cap on working hours for ALL student visas has been removed and working holidaymaker visas will now be able to work for the same business for the entirety of their visa.

Working holidaymakers who are offshore and come to Australia within the next 3 months with a valid working holiday visa will receive a full rebate of their Visa Application Charge, while student visa holders who arrive in Australia within 2 months will receive the VAC back from the government.

“We want you to come to Australia and enjoy a holiday here … move all the way around the country,” Mr Morrison said.

“At the same time, join our workforce and help us in our agricultural sector, in our hospitality sector, and so many of the other parts of the economy that rely on that labour.”

Temporary graduate visa holders are now eligible for an automatic extension to their visas until the 30th of September and a new Covid-19 stream for temporary graduate visa holders will come into effect on 1st July 2022.

People from the UK will be able to apply for a second or third Working Holiday Maker visa without having to carry out the previously required specified work, including agricultural work.

The Australia – United Kingdom Free Trade Agreement (AUKFTA) was recently signed by the UK and Australia, it includes the new requirements for Working Holiday Makers from the UK.

New South Wales will be opening applications for their Skilled Work (Provisional) visa (Subclass 491) for which you must submit a new Registration of Interest (ROI) before the end of October.

If you were not invited in August you must submit a new ROI for the October round.

In Queensland the skilled migration program restart, slated for the end of September will be delayed until a final round of industry consultation by a Queensland Government Department  is carried out to determine program requirements.

Has your Working Holiday-Maker (WHM) visa been affected by the Covid-19 Pandemic? 

From July 1st, 2021 holders of WHM visas (subclass 417 and 462) will be treated as if they have not held their most recent WHM visas when applying for subsequent visas.

This will restore many applicants’ eligibility for a first, second, third or even fourth WHM visa if their most recent visa was affected by the pandemic.

The changes to visa eligibility don’t stop there, if you hold one WHM visa you will not be required to complete 3 months of specified work in order to apply for a second WHM visa.

If you are on your second WHM visa, you will be required to work just 3 months of specified work for your third WHM visa and if you are on your third WHM visa you only need 6 months of specified work to apply for a fourth WHM visa.

Also as of the 8th of May, 2021 the tourism and hospitality industries have been added to the list of Covid-19 critical sectors, meaning WHM visa holders will no longer have to request permission to work longer than 6 months in a job in these industries. 

WHM visa holders who have had to leave Australia early because of the pandemic event or who were not able to come to Australia do not have to pay the Visa Application Charge (VAC) for a subsequent WHM visa.

This is also the case for WHM visa holders who were granted a Pandemic Event visa (subclass 408).

Backpackers can extend stay by volunteering in fire-ravaged communities as visa conditions are relaxed

Visa conditions relaxed for backpackers in Australia who hold working holiday visas may now be able to stay longer if they help out on farms that were affected by the bushfires.

Australia’s acting minister for immigration Alan Tudge says the new rules are about getting “as many boots on the ground as they need”. The new rules have been introduced with immediate effect.

“These hard-working Australians have been hit by the recent bushfires, but from today they can employ backpackers for six months longer, helping them at a critical time in the recovery effort, it means working holiday makers can help rebuild homes, fences and farms, they can get onto properties and help with demolition, land clearing, and repairing dams, roads and railways.”

Under the current working holiday & work and holiday systems, to be eligible for a second-year visa, backpackers must do 88 days of regional work in specific regions. Volunteer work is not counted and employers can only take on the same backpacker for six months.

Under the new plans, volunteer work in regions affected by the bushfires for periods of up to a year will now count towards a second and third-year visa.  The changes are designed to encourage working holidaymakers to live and work in disaster zones across Australia. There currently 45 communities class as disaster areas.

More than 200,000 working holiday visas were issued last year to people aged between 18 and 30 years.
