Visa waiting times for Australia have dramatically reduced following a change in government and priorities. In a statement from the department of Home Affairs, it was claimed that visas can now be processed in just three days.

The huge shift in visa waiting times for Australia is down to a Ministerial Direction involving the prioritising of Health and Education skilled visas. The country’s largest state by population, New South Wales even set up an office in Mumbai to attract more migrants and international students.

The state has gone as far as to do away with work experience and minimum points scores for its subclass 190 visa. The state nominated visa is offered to those who apply to wish to live in that state and every Australian state is allocated places to help manage their labour market.

The visa is very handy for those who wish to stay in Australia long term as it can be granted as a permanent visa. There are many opportunities in a country where the new government has stated that a review of the country’s migration programme is on the cards. 

The Albanese Government has outlined that they wish to shape the programme for the decades to come and an Australian public think tank, the Grattan Institute, made a submission to the federal government about the need for long term migration.

“Permanent skilled migration must select younger, skilled talent to stay in Australia long-term, not address short-term skills shortages.”

Australia is a very good place to migrate to. Huge amounts of space, defined by rugged natural beauty means that the country enjoys a peaceful existence. At the moment, there is a historically low unemployment rate, migrating to Australia could be the best thing you ever do.

The average wage of an engineer in Australia is just over AU$100,000, according to recruitment site Indeed and the national minimum wage is AU$21.38 per hour or AU$812.60 per week.

Last year an Australian Labor government was elected, the migration intake was increased a significant 35,000 places in its 2022-23 migration program. 

The country’s intake is now capped at 195,000 places, but ask anyone in the land down under about the country’s skills shortage and you will find out that many businesses are suffering from a chronic shortage of workers. 

Many have started to limit opening hours, reduce capacity or even close up shop completely, simply because they cannot find staff to fill positions.

Prime Minister Anthony Albanese hinted at how the Australian migration program would be managed in the coming years at the Jobs and Skills Summit, saying that Australia would have to take a long term approach to planning.

“We can’t just have this over-reliance on temporary labour. And there are so many professions, whether it’s nursing, whether it’s engineers, whether it’s chefs, where we’ve had skills shortages for a long period. It makes no sense to bring people in, have them for a few years, then get a new cohort in to adapt to the Australian work environment.”

The sunburnt country has always been a number one destination for those looking for something better, migrating to Australia brings with it challenges, but the rewards are definitely worth it.

Partner and child visas will start being granted on the 27th of February, 2021 while parent visas will begin to be granted on the 24th of March while temporary graduate visas will no longer be required to be onshore to lodge their visas.  

The raft of expected changes will also see safe haven enterprise visa applicants able to apply despite receiving benefit payments and periods of unemployment as well as business innovation residency requirements being retracted.

Skilled regional visa applicants now only have to do 9 months full time work and 18 months residence in a regional area if offshore at the time of application. Applicants from inside Australia need to do the usual 2 years residence and 9 months full time work.

Changes are active for visas applied for since the start of the concession period which began on the 1st of February, 2020.

Business innovation visa applicants will be able to count time spent overseas towards the 1 year residency requirement in the 2 years before they applied for the visa if they held a business innovation visa. The first business innovation visa in the business innovation stream must have been granted on or before 30th June, 2019.

Subclass 485 visas, the Graduate Work, the Post Study Work and the Second Post Study Work streams will all be granted concessions and may now be applied for from overseas.

These expected changes mark a big shift in Australia’s immigration activities and are the start of the government’s response to the migration crisis facing Australia in a post-pandemic world.

Prime Minister Morrison and the Australia Government have announced changes (9/7/20) to existing and future visas which will provide permanent residency pathways for Hong Kong Australian visa holders (students, temporary skilled visa holders) and certain Hong Kong residents.
 
Priority will be given to Hong Kong residents who apply for a Business Innovation and Investment (Provisional) visa which allows a person to own and manage a business in Australia or undertake an entrepreneurial activity. Requirements for this visa include but are not limited to providing employment for Australian Citizens.
 
Current and future students from Hong Kong will be eligible for a five-year temporary graduate visa once they complete their studies.

TSS Visa What You Need To Know – Are you ready for the 457 visa termination?

From March 2018, the 457 visa for Australia will be abolished. For many Australian employers and existing temporary migrants, this change will have consequences. We have spoken to many employers over the years who have complained that they have struggled to find qualified, experience good staff (hence their reasoning to sourcing overseas skilled workers). Employers who are considering recruiting overseas employees will need to be aware of the changes in the different types of visas and the tax implications that will apply.

Who is eligible for TSS?

For an employer to recruit an overseas skilled worker, the vacant position must appear on the Combined List of Eligible Skilled Occupations. Position description and the TSS visa applicant’s employment and education history must reflect the description provided by ANZSCO. If applicants do not come from one of the exempt countries (UK, USA, Canada, NZ or Ireland), they will also need to meet English language requirements.

Out of the current 651 occupations eligible for 457 visas, only 435 jobs categories will be suitable for Temporary Skilled Shortage (TSS) visa.

TSS will come in two categories: Short-Term Skilled Occupations List (STSOL)  a two-year visa that can be extended only once and offers no pathway to permanent residency; and Medium and Long-Term Strategic Skills List (MLTSSL) a four-year visa which can lead to Australian permanent residency after three years.

How do I apply for TSS?

TSS ( like 457) will be a three-step application process.

  • Standard Business Sponsorship (SBS)  – To be able to employ overseas skilled workers on a TSS visa business must be approved as Standard Business Sponsor.   For a Business to be eligible for SBS it must have an active ABN to apply under, registering the business name, supplying Business Activity Statements (BAS) and financial statements, as well as showing a commitment to training Australian citizens and permanent residents and compliance with workplace and other Australian laws.
  • Nomination –  is the next step. This is when the employer must nominate a position within their business as one which must be filled by an overseas citizen. As part of this step, there are various requirements to be met: for example labour market testing, salary level and training levy.
  • Visa application –  Finally it’s the visa application, at which time the applicant must demonstrate that they meet the requisite skill level for their occupation, as well as health and character requirements.
